Tutti gli acquisti effettuati sul sito http://www.maxder.com, sono soggetti alle discipline del D.Lgs. n° 185 del 22/05/1999 dettata in materia di contratti a distanza, nei casi in cui la consegna della merce avvenga al domicilio dell'acquirente (cliente), in quanto detti acquisti si perfezionano al di fuori dai locali commerciali. Essenzialmente, tale normativa, riveste particolare importanza per quanto attiene il Diritto di Recesso riservato all'acquirente (cliente).La normativa comunitaria prevede che il diritto di recesso sia esercitabile dalle sole persone fisiche (consumatori) che agiscono per scopi che possono considerarsi estranei alla propria attività commerciale. Il diritto di recesso, quindi, non può essere esercitato dalle persone giuridiche e dalle persone fisiche che agiscono per scopi legati ad una attività commerciale. Restano esclusi dal diritto di recesso anche gli acquisti effettuati da rivenditori o da soggetti che a qualsiasi titolo acquistano per la rivendita a terzi. Il consumatore ha diritto di recedere dal contratto entro il termine di 14 giorni lavorativi dal ricevimento della merce, restituendo il bene oggetto del recesso al venditore, il quale gli rimborserà il prezzo della merce restituita. Si precisa che nelle ipotesi di operazioni a premio (ovvero le cosiddette promozioni), in cui l'acquisto di un bene è abbinato ad un altro bene che viene venduto ad un prezzo irrisorio o addirittura regalato, il diritto di recesso sarà legittimamente esercitato con la restituzione di entrambi i beni oggetto dell'acquisto, stante il vincolo dell'accessorietà del bene in promozione rispetto al primo. Il diritto di recesso si applica solo se la confezione originale del prodotto è sigillata ed integra. Prima di contattare Maxder Group srl, è opportuno avere a disposizione i seguenti documenti e dati: fattura originale (con riportato numero di ordine, di fattura, di codice cliente); in caso di recesso parziale, oltre alla fattura di acquisto, il codice articolo/i; coordinate bancarie sulle quali ottenere il bonifico (Cod. ABI - CAB - Conto Corrente dell'intestatario della fattura). Per esercitare il diritto di recesso, inviare entro il termine di quattordici giorni una raccomandata con avviso di ricevimento a: Maxder Group srl - Via Ludwig Van Beethoven 24- 20092 Cinisello Balsamo (Mi) - dove il cliente dichiara di volersi avvalere del diritto di recesso, che i prodotti che si intende restituire sono nella loro confezione sigillata e integra specificando il numero di fattura, i codici prodotto e le quantità di merce che s'intendono restituire. è possibile inviare la comunicazione, entro lo stesso termine, anche mediante telegramma, telex, posta elettronica e fax, a condizione che sia confermata mediante lettera raccomandata con avviso di ricevimento entro le quarantotto ore successive.
La merce andrà restituita nel proprio imballo originale protetto da altro involucro adatto ad evitare qualsiasi alterazione dell'imballo originale durante il trasporto; dovranno essere presenti tutti gli accessori e non dovranno esserci segni d'usura o danneggiamento. Gli articoli dovranno in altre parole essere rivendibili come nuovi. Spedire la merce a proprie spese, al seguente indirizzo: Maxder Group srl - Via Ludwig Van Beethoven 24 - 20092 Cinisello Balsamo (Mi) Entro dieci giorni dal ricevimento la merce sarà esaminata e se risponderà ai requisiti di cui sopra verrà disposto bonifico bancario entro 30 giorni lavorativi dal ricevimento della stessa, la ditta Maxder Group srl provvederà ad effettuare l'accredito al Cliente dell'importo corrispondente al valore della merce risultante dalla fattura. Nel suddetto importo non sono comprese le spese di spedizione. Ciò in conformità all'art. 5, comma 6, D.Lgs n. 185 del 22/05/1999. Maxder Group srl si riserva sin d'ora di non accettare le spedizioni prodotti che: siano state effettuate senza aver attivato la richiesta di intervento prevista dalle correnti condizioni; siano state effettuate senza seguire le modalità di invio previste dalle correnti condizioni. In tutti casi le spese di trasporto inerenti la restituzione saranno a carico del cliente.
I prodotti sono coperti da una garanzia per un periodo di 12 mesi. La garanzia legale copre i difetti di conformità e nn ha guasti accidentali o danni da usura nel tempo.
Il nostro minimo fatturabile è € 100,00 + Iva, la merce viaggia a rischio dell‘acquirente e può essere assicurata a suo carico previo avviso telefonico o tramite email. Ogni danno di trasporto va reclamato allo spedizioniere prima di accettare la merce avvisando inoltre immediatamente il mittente. Eventuali reclami devono pervenire entro 10 giorni dalla consegna della merce. Il materiale reclamato deve pervenire entro 8 giorni dalla consegna (previo nostra autorizzazione) con l'imballo e la merce nelle condizioni originali di vendita. L'invio del reso è a carico del cliente. I prodotti sono da restituire integri e nella loro confezione originale e con adeguato imballo esterno. Ci si riserva la facoltà di riparare o sostituire il pezzo reclamato a discrezione del produttore. Sono esclusi i danneggiamenti conseguenti ad uso improprio da parte dell‘acquirente o da terzi, ad usura o a trattamento dannoso o negligente. Il venditore non risarcirà eventuali costi se non quelli del prodotto stesso. L'acquirente riceverà la sostituzione del prodotto ordinato o il rimborso dell'importo con esclusione delle spese di trasporto e di riaccredito. Ogni articolo sottoposto per legge a limitazioni d'uso, viene venduto affinché l'acquirente lo utilizzi con rispetto delle norme previste che ne regolano l'utilizzo.

All purchases made on the website http://www.maxder.com are subject to the disciplines of Legislative Decree no.185 of 22/05/1999 dictated in the matter of distance contracts, in cases where the delivery of the goods takes place at the domicile of the 'buyer (customer), as these purchases are completed outside the business premises. Essentially, this legislation is of particular importance as regards the Right of Withdrawal reserved for the buyer (customer). Community legislation provides that the right of withdrawal can be exercised only by natural persons (consumers) who act for purposes that can be considered unrelated to the own business. The right of withdrawal, therefore, cannot be exercised by legal persons and natural persons acting for purposes related to a commercial activity. The right of withdrawal also excludes purchases made by resellers or by subjects who in any way purchase for resale to third parties. The consumer has the right to withdraw from the contract within 14 working days of receipt of the goods, returning the goods subject to withdrawal to the seller, who will refund the price of the returned goods. It should be noted that in the hypothesis of prize operations (i.e. the so-called promotions), in which the purchase of an asset is combined with another asset that is sold at a ridiculously low price or even given as a gift, the right of withdrawal will be legitimately exercised with the return of both goods object of the purchase, given the constraint of the accessibility of the goods in promotion with respect to the first. The goods will be returned in their original packaging protected by another suitable wrapping to avoid any alteration of the original packaging during transport; all accessories must be present and there must be no signs of wear or damage. In other words, the items must be re-salable as new. Send the goods at your own expense, to the following address: Maxder Group srl - Via Ludwig Van Beethoven 24 - 20092 Cinisello Balsamo (Mi) Within ten days of receipt, the goods will be examined and if they meet the above requirements, a bank transfer will be arranged within 30 working days of receipt of the same, the company Maxder Group srl will proceed to credit the Customer with the amount corresponding to the value of the goods resulting from the invoice. The aforementioned amount does not include shipping costs. This in accordance with art. 5, paragraph 6, Legislative Decree n. 185 of 22/05/1999. The products are covered by a warranty for a period of 12 months. The legal guarantee covers conformity defects and does not have accidental failures or wear damage over time.
Our minimum billable is € 100.00 + VAT, the goods travel at the risk of the purchaser and can be insured against him upon notice by telephone or by email. Any transport damage must be claimed to the shipper before accepting the goods, also immediately informing the sender. Any complaints must be received within 10 days of delivery of the goods. The sending of the return is the responsibility of the customer. The products must be returned intact and in their original packaging and with adequate external packaging. We reserve the right to repair or replace the claimed part at the manufacturer's discretion. Damages resulting from improper use by the buyer or third parties, wear or harmful or negligent treatment are excluded. The seller will not reimburse any costs other than those of the product itself. The buyer will receive the replacement of the ordered product or the refund of the amount with the exclusion of transport and re-credit costs. Each article subjected by law to limitations of use, is sold for the buyer to use it in compliance with the rules governing its use.
