CONDITIONS Our minimum billable amount is €100.00 + VAT. The goods travel at the buyer’s risk and can be insured at their expense upon prior notification by phone or email. Any transport damage must be reported to the shipper before accepting the goods and the sender must be immediately notified as well. Any complaints must be submitted within 10 days from the delivery of the goods. The disputed material must be returned within 8 days of delivery (upon our authorization) with the original packaging and goods in the same condition as they were sold. The return shipment is at the customer’s expense. The products must be returned intact, in their original packaging, and with appropriate external packaging.

We reserve the right to repair or replace the disputed item at the manufacturer’s discretion. Damages resulting from improper use by the buyer or third parties, wear and tear, or harmful or negligent treatment are excluded. The seller will not reimburse any costs other than the product’s price itself. The buyer will receive either a replacement of the ordered product or a refund of the amount, excluding transportation and re-credit costs. Any item subject to legal usage restrictions is sold on the condition that the buyer uses it in compliance with the regulations governing its use.**

RIGHT OF WITHDRAWAL All purchases made on the website https://www.maxderbanchi.com are subject to the provisions of Legislative Decree No. 185 of 22/05/1999 regarding distance contracts, in cases where the delivery of goods is made to the buyer’s (customer’s) home, as these purchases are concluded outside of commercial premises. Essentially, this regulation is particularly important regarding the Right of Withdrawal granted to the buyer (customer). EU regulations stipulate that the right of withdrawal can only be exercised by individuals (consumers) who act for purposes unrelated to their commercial activity. Therefore, the right of withdrawal cannot be exercised by legal entities or individuals acting for commercial purposes. Purchases made by resellers or by individuals purchasing for resale to third parties are also excluded from the right of withdrawal. The consumer has the right to withdraw from the contract within 14 working days from receipt of the goods, returning the item(s) to the seller, who will refund the price of the returned goods. It is specified that in cases of promotional offers (where a product is purchased along with another product sold at a negligible price or even given for free), the right of withdrawal must be exercised by returning both products involved in the purchase, due to the accessory nature of the promotional item. The right of withdrawal applies only if the original packaging of the product is sealed and intact.

Before contacting Maxder Group srl, it is advisable to have the following documents and information ready:

• Original invoice (with order number, invoice number, and customer code).
• In case of partial withdrawal, the invoice along with the article code(s).
• Bank details for the refund (ABI code, CAB code, bank account of the invoice holder).

To exercise the right of withdrawal, send a registered letter with return receipt within fourteen days to: Maxder Group srl – Via Ludwig Van Beethoven 24 – 20092 Cinisello Balsamo (Mi), where the customer declares their intention to exercise the right of withdrawal, stating that the products to be returned are in their sealed and intact packaging, specifying the invoice number, product codes, and quantities of goods to be returned.

The communication can also be sent by telegram, telex, email, or fax within the same period, provided it is confirmed by registered letter with return receipt within 48 hours.

RETURN SHIPPING OF THE ITEMS The goods must be returned in their original packaging, protected by an additional wrapper suitable to prevent any alteration of the original packaging during transport; all accessories must be included, and there must be no signs of wear or damage. In other words, the items must be resalable as new. Return the goods at your own expense to the following address: Maxder Group srl – Via Ludwig Van Beethoven 24 – 20092 Cinisello Balsamo (Mi). Within ten days of receipt, the goods will be examined, and if they meet the above requirements, a bank transfer will be issued within 30 working days of receipt. Maxder Group srl will credit the customer with the amount corresponding to the value of the goods as shown on the invoice. Shipping costs are not included in the refunded amount. This is in accordance with Article 5, paragraph 6, Legislative Decree No. 185 of 22/05/1999. Maxder Group srl reserves the right to reject product shipments that:

• Were sent without having activated the intervention request as per current conditions.
• Were sent without following the return procedure as per current conditions.

In all cases, the customer will bear the return shipping costs.

PICK-UP FROM OUR FACILITY Goods can be picked up at our store located in Cinisello Balsamo (MI), Via Ludwig Van Beethoven 24, during the following hours: 8:30 AM – 12:30 PM and 2:00 PM – 6:00 PM. Payment can be made in advance or in cash directly at our facility, with no additional charge.
